Child Support and Extracurricular Activities: Who Pays in California?
The cost of extracurricular activities for children add up quickly. During and after a divorce or separation, one of the questions parents most commonly face is whether these extracurricular activities are covered by child support, and if so, who is responsible for paying it. In California, the answer is more nuanced than many parents expect.
How California Categorizes These Costs
Base child support in California is calculated using a mandatory formula set out in California Family Code section 4055. That formula accounts for each parent’s income and how much time the child spends with each parent. It is designed to address the child’s basic needs like food and clothing. Extracurricular activities are treated differently.
California courts recognize extracurricular activities as “discretionary” child support “add-ons,” which are expenses handled separately from the base child support amount. California Family Code section 4062 divides add-ons into two categories: mandatory and discretionary. Mandatory add-ons, such as work-related childcare and uninsured medical expenses, must be ordered by the court. Extracurricular activities, by contrast, are “discretionary” add-ons, meaning a court has the authority to order them but is not required to. A judge will consider whether the activities are in the child’s best interests.
Who Pays, and How Much?
If a court does order extracurricular expenses as a discretionary add-on, how those costs are split between parents has changed significantly in recent years. Prior to September 1, 2024, add-ons were typically divided 50/50 between parents unless one parent specifically requested a different arrangement. Under Senate Bill 343, which took effect on September 1, 2024, California Family Code section 4061 now requires that add-ons be allocated proportionally based on each parent’s net disposable income rather than split equally. This means the higher-earning parent will generally bear a larger share of these costs, while the lower-earning parent’s share is reduced accordingly.
The practical impact is significant. If one parent earns considerably more than the other, an equal split of extracurricular costs may no longer reflect what the law now requires. Parents who finalized support orders before this change may want to revisit whether their current arrangement aligns with the updated rules.
What Happens When Parents Disagree?
Disagreements over extracurricular activities are common. What if one parent wants to enroll the child in an expensive activity and the other objects to the cost? Courts look at several factors in these situations, including:
- Whether the activity is consistent with the child’s established interests and lifestyle before the separation
- The cost of the activity relative to both parents’ incomes
- Whether enrolling the child serves their educational or developmental needs
- Whether the activity was part of the family’s routine during the marriage
Parents also have the option to address extracurricular costs directly in their parenting agreement, specifying which types of activities will be covered and how the expenses will be divided. This can reduce conflict later and give both parents a clearer framework for decision-making as the child grows and their interests evolve.
